Investigation Report Into the Alleged Sexual Harassment of Female Employees of Malawi Broadcasting Corporation by Mr. Aubrey Sumbuleta

Abstract

This report details the Malawi Human Rights Commission's investigation into allegations of sexual harassment at the Malawi Broadcasting Corporation (MBC) by Mr. Aubrey Sumbuleta. The investigation was initiated following a public post by an MBC employee and a formal petition from the Human Rights Defenders Coalition (HRDC). The Commission's methodology involved a quasi-judicial hearing, which included testimony from four complainants, the respondent, and ten witnesses, as well as a review of relevant laws and documents. The report's factual findings conclude that Mr. Sumbuleta did sexually harass four female employees on different occasions and that these acts were in violation of their human rights. The report also makes a legal finding that the working environment for the women became hostile after they refused Mr. Sumbuleta's advances, which led to two of them resigning. The Commission also found that MBC was liable for failing to have a workplace sexual harassment policy, which institutionalized sexual violence. The report concludes with recommendations for civil and criminal action against Mr. Sumbuleta, the reinstatement of two employees, and the finalization and implementation of a sexual harassment policy at MBC
